Where Is Kratom Legal And Where Is It Illegal? An Updated Kratom Legality Map Of The USA And The Rest Of The World

Kratom has an extremely complex legal topography, since it is legal in most of the United States and many countries around the world, while simultaneously being illegal in several states and numerous countries. The below article will detail where exactly Kratom is legal and where it is illegal, starting with the United States and then discussing the rest of the world.

Before diving into this article one thing I want to note is that it is truly humbling and frightening how Kratom is banned in dozens of countries worldwide, and in-fact Kratom is illegal for billions of people across the globe. This truly illustrates how the Kratom community cannot take Kratom’s legality for granted, and that we need to keep fighting as hard as we can to keep Kratom legal in the United States.

Kratom Legality In The United States

Due to an aggressive FDA and Big Pharma misinformation campaign, Kratom was almost banned in the United States in 2016. Miraculously, Kratom was ultimately not banned on a Federal level, but six states including Alabama, Arkansas, Indiana, Rhode Island, Vermont, and Wisconsin did ban Kratom, and Kratom remains banned in those states to this day, despite the fact that the FDA’s misinformation campaign has been thoroughly debunked by science. The states where Kratom is banned can be seen in the below map.

Additionally, some municipalities have banned Kratom including Sarasota Florida, a couple of municipalities in Colorado, San Diego California, several counties and cities in Mississippi, Franklin New Hampshire, and Jerseyville Illinois, and these are approximated by red dots on the above map.

Notably, this map is definitely subject to change, and the Kratom community needs to keep a close eye on Kratom related legislation. Earlier in 2020 several state Kratom bans, such as in South Dakota and Maryland, were defeated, and it is unfortunately quite likely that state Kratom ban proposals will pop up again in 2021, especially since a new administration is coming into power following the January 20 inauguration.

That being said, it is also possible that some of the states where Kratom is banned will repeal their Kratom bans, and indeed this has already happened in Washington D.C., where Kratom was banned in 2016 and then legalized in 2019.

Kratom Legality Worldwide

In the below map countries filled in with red are where Kratom is outright banned. China is filled in with yellow because there’s not enough information to state that Kratom is definitively banned there, but there are indications that Kratom is illegal in China. The United States is filled in with orange, meaning Kratom is legal in some areas and illegal in other areas, and notably the United States is the only country with this mixed Kratom legality status. Finally, Indonesia is filled in with purple, meaning a Kratom ban is pending to start at the beginning of 2022.

Kratom Legality In Africa

Breaking down this Kratom legality map by continent, Africa is a friendly continent for Kratom users, since no country in Africa has banned Kratom.

Kratom Legality In Europe

Europe is one of the harshest continents when it comes to Kratom laws, with numerous European countries having Kratom bans in place including Belarus, Bulgaria, Croatia, Denmark, Estonia, Finland, France, Iceland, Ireland, Latvia, Lithuania, Luxembourg, Moldova, Norway, Poland, Romania, Russia, Slovenia, Sweden, Switzerland, and the United Kingdom.

Notably, European countries began banning Kratom as early as 2009, and even this year France banned Kratom.

Kratom Legality In Asia

The legality of Kratom across Asia is quite complex. First off, Kratom is definitively banned in Japan, South Korea, Taiwan, and Singapore.

Also, Kratom is banned in several countries where Kratom natively grows including Thailand, Malaysia, and Myanmar.

Likewise, Kratom is technically banned in Indonesia, except it is still allowed to be exported until the beginning of 2022. That being said, it is not set in stone that Kratom will ultimately become fully illegal in Indonesia since the American Kratom Association and Indonesian Kratom growers are vigorously fighting against this ban. 95% of America’s Kratom comes from Indonesia, so it will be devastating if the Kratom ban goes into full effect in Indonesia at the beginning of 2022.

As for China, the world’s most populous country, it is unclear if there is any specific law which bans Kratom, although reports on the internet indicate that Kratom is banned in China, so on the map it is filled with Yellow.

Kratom Legality In The Middle East

Israel, Turkey, and the United Arab Emirates have explicit Kratom bans. Kratom would likely be banned in most of the rest of the Middle East as well, since drug policies in the Middle East are extremely harsh, except Kratom is so uncommon in the region that regulators in most Middle Eastern nations have not taken the time to ban Kratom.

Kratom Legality In Oceania

Kratom is illegal in all of Oceania, including Australia and New Zealand, although the exception is that doctors are allowed to prescribe Kratom in New Zealand.

Kratom Legality In South America

Argentina lists Mitragynine as a controlled substance, and therefore Kratom is banned there. Kratom is legal in all of the other countries in South America.

Kratom Legality In North America

North America is another friendly continent for Kratom users, with no countries in North America or the Caribbean having Kratom bans in place. The only places where Kratom is banned in North America are the states and municipalities mentioned earlier in this article.

Notably, Canada has banned the sale of Kratom for human consumption, but Kratom is not illegal in Canada, and is simply sold as not for human consumption.
